Firm Secures Victory Against Claim for Unpaid Overtime Wages

Primmer Piper Eggleston & Cramer PC attorneys Alexandra Edelman and Ryan Long published an article in the May issue of the ABI Journal, the publication of the American Bankruptcy Institute, that highlights their recent victory in the United States Bankruptcy Court for the District of Vermont. Edelman and Long successfully moved to dismiss an involuntary bankruptcy petition filed by creditors against Koffee Kup Bakery, Inc., a Vermont bread manufacturer widely regarded as a Vermont institution that had been in business since the 1940s. The Bankruptcy Court’s ruling sets forth a new standard in Vermont and likely elsewhere in the Second Circuit on how to analyze disputes concerning a portion of a claim asserted by creditors in an involuntary bankruptcy petition, and whether that portion constitutes a “separate transaction.”
