Richard Windish and Elizabeth Willhite successfully defended the firm’s client, a non-profit agency in the Northeast Kingdom serving thousands of Vermonters each year, from claims that the agency failed to meet the standard of care in its delivery of Medicaid waiver services. The initial action was filed in federal court, but after another defendant settled with the Plaintiff the case was re-filed in state court. Our team defended our client through both the federal and state cases, over a period of nearly seven years. On the eve of trial, the remaining co-defendant settled with Plaintiff. However, our team proceeded to trial. After a two week jury trial in Caledonia County, the jury returned a verdict in favor of our clients in less than two hours, finding no fault and awarding no damages to Plaintiff.
