New Paycheck Protection Program (“PPP”) Clarification

On Tuesday, April 14, 2020, the Small Business Administration (“SBA”) issued a second interim final rule (“Second Rule”) that supplements the guidance for the Paycheck Protection Program (“PPP”) provided in the first interim final rule for the PPP issued on April 2. The Second Rule offers additional guidance for individuals with self-employment income who file a Form 1040, Schedule C.

On March 13, 2020, President Trump issued a National Emergency Declaration. Pursuant to Section 1135 of the Social Security Act and the President’s declaration, along with the Secretary of Health and Human Services' previous Public Health Emergency Declaration on January 31, 2020, the Centers for Medicare and Medicaid Services (CMS) is authorized to waive certain requirements and conditions of participation for Medicare, Medicaid, and the Children’s Health Insurance Program (CHIP).
